Cuba Declares May 2 Substitute Public Holiday

Cuba's Ministry of Labor and Social Security has announced the declaration of Monday, May 2, 2022, as a substitute public holiday in Cuba "since the rest corresponding to Workers' Day is transferred".

As per the aforementioned announcement, "Workers who work on Sunday must apply double payment of salary for all hours worked".

The declaration of Monday, May 2, 2022, as a substitute public holiday in Cuba is in line with the previously-announced list of 2022 public holidays in Cuba, as released by the government of Cuba, earlier this year (2022-01-06), and which was based on "artículo 96 de la Ley 116 del Código de Trabajo", which specifies day in lieu substitute public holidays when a public holiday falls on a Sunday ("when the days of national commemoration coincide with a Sunday, it is transferred to the next day").

However, no substitute public holiday is specified for public holidays falling on a Saturday, and therefore, the recent declaration of Monday, January 3, 2022, as a substitute public holiday in Cuba, was a departure from the terms of the "artículo 96 de la Ley 116 del Código de Trabajo".
