The Kenyan government, through government spokesman, Alfred Mutua, has announced that contrary to earlier announcements, Monday, December 27, 2010, would not be a public holiday in Kenya.
The declaration of day in lieu public holidays is semi-systematic in Kenya, based on an on-going interpretation of sections 3 & 4 of the Public Holidays Act.
However, in his statement, Dr. Mutua did not refer to sections 3 & 4 of the Public Holidays Act, but rationalized the Kenyan government's decision by the statement that "Due to the many holidays this year, Monday, December 27th, is a normal working day and is not a public holiday.". One of these many holidays must have been the December 13 public holiday declared earlier this year, to most observers' surprise (10-Dec-2010).
In a separate statement, the Nairobi Stock Exchange (NSE) announced it had planned to close on Monday, but that it would open on Monday, December 27, 2010, following the government's announcement that that date would not be a public holiday "as is normally the case when a public holiday falls on a Sunday".
