Nigeria's Minister of Interior, Emmanuel Ihenacho, has issued an announcement, signed by his Assistant Director, Timothy Oyedeji, declaring Monday, May 31, 2010, as a day in lieu public holiday on account of this year's Democracy Day.
Apparently, the aforementioned day in lieu public holiday was declared as Democracy Day, observed annually on May 29, falls on a Saturday this year. This, despite the fact that articles 5a to 5d of the current laws regulating public holidays in Nigeria, the Public Holidays Act of 1979 (chapter 378), and the Public Holidays Act of 2004 (Cap.P40, Vol.14 Laws of the Federation of Nigeria, 2004), stipulate that no day in lieu is to be given to compensate any public holiday that falls on a Saturday or Sunday.
In the past, some rare exceptions were made to the law, most recently in 2007 (31-Mar-2007) and 2006 (28-Sep-2006), but since the advent of President Goodluck Jonathan, this seems to have become the norm (01-May-2010). Were this to be the case then we could see similar declarations of day in lieu public holidays on Monday, December 27, and possibly even on Tuesday, December 28, 2010.
