The Union Territory of Puducherry has issued the vide notification number 1691/AIL/Lab/G/2021 which declares Tuesday, April 6, 2021, as a public holiday in Puducherry on account of the General Election to Puducherry Legislative Assembly, 2021, being held on that day.
The vide notification number 1691/AIL/Lab/G/2021 states that "In connection with the General Election to Puducherry Legislative Assembly, 2021 scheduled to be held on 06.04.2021 (Tuesday) in the Union territory of Puducherry, it is informed that the occupiers/employers of all Factories, Industries, Shops and other Establishments located in the entire Union territory are hereby instructed to grant paid holiday to all their employees on Tuesday, the 6th April, 2021 as per section (1) and (2) of Section 135-B of the Representation of People Act, 1951 in order to enable them to exercise their franchise on the polling day.".
It also quotes the relevant provisions of the Representation of People Act, 1951, namely that "Every person employed in any business, trade, industrial undertaking or any other establishment and entitled to vote at an election to the House of the people or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday." and that "No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with subsection (1) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.".
The aforementioned declaration of Tuesday, April 6, 2021, as a public holiday in Puducherry thus amends the Government of India's Union Territory of Puducherry's announced list of official state non-working public holidays in India's Union Territory of Puducherry for the calendar year 2021, as released last autumn (2020-10-09) in the G.O. Ms. No. 80, Puducherry, dated 7th October 2020.
