Dominican Republic Public Holidays Amended

The Ministry of Labour of the Dominican Republic has issued the Resolución No. 01/2011 which specifies that, in 2011, the August 16, Restoration Day, non-working public holiday will be observed on Tuesday, August 16, 2011, and not on the nearest Monday.

As per the aforementioned resolution; "Se declara día feriado, de fiesta nacional y no se cambia la fecha de su celebración el martes 16 de agosto del año 2011, día de la Restauración de la República".

In the late nineties (1997-06-19), The Congress of the Dominican Republic passed the "Ley No. 139-97 mediante la cual los días feriados del calendario que coincidan con los días martes y miércoles, jueves o viernes serán trasladados de fecha" which moves some of the fixed-date mid-week public holidays to the nearest Monday.

However, a couple of years ago (2008-02-21), a Supreme Court ruling declared unconstitutional, articles 1-2-4 of law 139-97, which move the August 16 Restoration Day public holiday to the following Monday, whenever it falls on a Tuesday, Wednesday, Thursday or Friday.

Nonetheless, the 2011 observance of the August 16 non-working public holiday was specified as Monday, August 15, 2011, in last fall's announcement (2010-11-04) by the Ministry of Labour of the Dominican Republic of the official listing of public holidays in the Dominican Republic for the year 2011.
