Costa Rican Bill To Move Public Holidays To Fridays Progresses

The legislative proposal by Roberto Thompson to move the remainder of 2020 and 2021 public holidays to a nearby Friday, and create tourist long weekends, has been tabled as Legislative File No. 2194 and, more importantly, has been included in amendments to article 148 of the Labor Code included in the government roadmap presented by the Minister of Tourism of Costa Rica, María Amalia Revelo.

Last month (2020-04-22), we reported how a deputy of the National Liberation Party (PLN), had introduced legislation in the Costa Rican legislature, which would transfer the Costa Rican public holidays of 2020 and 2021 to Fridays, in order to promote internal tourism (July 25, August 2 and August 15 to the preceding Friday, and September 15 and December 1st to the following Friday, for both 2020 and 2021).

The creation of long weekend to promote tourism had been the crux of the Abel Pacheco's administration 2005 legislation (2005-03-17), which specified that 4 public holidays would move from mid-week to the following Monday (April 11, July 25, August 15, and October 12). But, that legislation had been progressively gutted, over the years by repeated court decisions (<9547>>, 2013-07-22, 2012-07-24, 2010-10-06, 2009-06-26, 2009-06-19, 2008-11-29, 2007-10-05 and 2007-08-10), with the current situation being that only one of the original 4 moving public holidays, October 12, is still covered by the terms of the 2005 law (2019-12-28).

Interestingly, this propensity of the courts to meddle with public holidays legislation, also revealed itself in neighboring Guatemala whose Constitutional Court recently issued a ruling removing the May 1st and October 20 public holidays from the scope of the 2018 Law of Internal Tourism (2020-04-16 and 2019-11-17). That law mandated that that public holidays falling on Tuesdays, Wednesdays, Thursdays, Saturdays or Sundays, should be moved to the working day immediately before or after the weekend (2018-10-11, 2018-09-26, 2018-08-09), in a vein similar to the earlier Decreto Número 42-2010 ("Ley que promueve el Turismo Interno"), issued in 2010, (2010-11-16 and 2010-05-13).
