Nigeria 2010-2011 Year-End Public Holidays Declared

Nigeria's Minister of Interior, Emmanuel Ihenacho, has issued a press statement declaring 3 exceptional, one-off public holidays to compensate year-end public holidays that fall on a weekend in 2010.

The press statement, signed by Assistant Director, Ogaziechi Theodore, specifies that the Federal Government of Nigeria has declared Monday and Tuesday, December 27 and 28, 2010, as day in lieu public holidays to compensate both the Christmas Day and Boxing Day annual public holidays falling on a weekend this year.

The statement went on to note that by the same reckoning, the Federal Government of Nigeria had also declared Monday, January 3, 2011, as day in lieu public holiday to compensate the upcoming New Year's Day annual public holiday falling on a Saturday.

Note that the aforementioned press statement goes against the letter and spirit of articles 5a to 5d of the current laws regulating public holidays in Nigeria, the Public Holidays Act of 1979 (chapter 378), and the Public Holidays Act of 2004 (Cap.P40, Vol.14 Laws of the Federation of Nigeria, 2004), which stipulate that no day in lieu is to be given to compensate any public holiday that falls on a Saturday or Sunday.

However, earlier this year (25-May-2010 and 01-May-2010), Nigeria had declared day in lieu public holidays tending to indicate that the new President, Goodluck Jonathan, had decided to avail himself of the power he has to declare additional public holidays.
