The Dominican Republic Ministry of Labour has announced that, contrary to what it had officially announced last fall, the non-working public holiday for the upcoming Restoration Day (Día de la Restauración) will be on Tuesday, August 16, 2011.
At the time when the official list of 2011 public holidays in the Dominican Republic was released (04-Nov-2010), we had commented that the listed date of Monday, August 15, 2011, for the Restoration Day public holiday was odd.
The reason was that the initial announcement of the list of 2011 public holidays in the Dominican Republic, ran counter to the 2008 Supreme Court decision (21-Feb-2008) which had declared as un-constitutional, articles 1-2-4 of law 139-97, which move the August 16 Restoration Day public holiday to the following Monday, whenever it falls on a Tuesday, Wednesday, Thursday or Friday (19-Jun-1997).
A government announcement (Resolución No. 01/2011) in January (06-Jan-2011) specified that, in 2011, the August 16, Restoration Day, non-working public holiday will be observed on Tuesday, August 16, 2011, and not on the nearest Monday. However that announcement went largely unnoticed in the general public.
As August 16 fell on a Saturday/Sunday/Monday in 2008/2009/2010, the aforementioned ruling was only to have a concrete effect, for the first time, in 2011, and as such was apparently overlooked by the Ministry of Labour in its initial announcement of the official list of 2011 public holidays in the Dominican Republic.
