The recent promotion of Carnival Tuesday from ponto facultativo to state public holiday, in the State of Rio de Janeiro, was ruled unconstitutional by the Supreme Court (Supremo Tribunal Federal, STF).
This follows a constitutional challenge (Ação de inconstitucionalidade, Adin) by the Brazilian business community association (Confederação Nacional do Comércio de Bens Serviços, CNC) which argued that because the status of public holiday means a paid day-off, it imposes additional labour regulations on employers, a prerogative reserved for the Federal government.
Carnival Tuesday was declared a ponto facultativo (optional day-off, without pay) at the national level, for 2009.
